Terms and Conditions

1. INTRODUCTION

1.1. These Terms and Conditions of Use (“Terms and Conditions”) regulate access to and use of this website https://quintadacorte.com/ (“Website”), which is the responsibility of Pacheco & Irmãos, Lda., registered at the Commercial Registry Office under the sole registration and tax identification number n.º 503 226 696, with registered office at Quinta da Côrte, 5120-491, Valença do Douro (“Quinta da Côrte”), and are applicable to online accommodation bookings (“Online Room Bookings”).

1.2. By using or accessing the Website or any of the information, data files, written text, graphics, links, audio files or other sounds, photographs, videos or other images (collectively, the “Content”), resources and services (collectively, including the Content, the “Services”) made available through the Website, you, as a user of or visitor to the same (“User”), (i) accept the Terms and Conditions and (ii) confirm that you have read and understood the Privacy Policy made available here.

1.3. Users of the Website may be but are not limited to: (i) all visitors to the Website; (ii) all clients and potential clients of Quinta da Côrte.

1.4. The Website consists of a consultation portal, with the intent of advertising products and services provided by Quinta da Côrte and attracting potential clients. Through the Website, Quinta da Côrte provides access to its Services, namely Online Room Bookings, which are subject to the present Terms and Conditions, including any updates, developments and/or new products.

2. USER MINIMUM AGE

2.1. The Website is intended for Users over the age of 18.

2.2. By accessing and/or using the Website or the Services made available through the Website, the User declares that: (i) he/she is 18 years of age or older; (ii) he/she is of legal age to access and use the Website; (iii) he/she is of legal age to enter into a binding contract with respect to these Terms and Conditions.

3. ONLINE ROOM BOOKINGS

3.1. The present Terms and Conditions regulate Online Room Bookings and are an integral part of the services contract entered into through the Website, between Quinta da Côrte and the client who subscribes to the contract (“Client”), which has as its purpose the provision of tourist accommodation booking services and the respective subsidiary tourist services in local accommodation owned and/or operated by Quinta da Côrte (“Contract”).

3.2. The Contract shall be deemed entered into with the confirmation of the booking, through the Website, in accordance with these Terms and Conditions, whose knowledge and acceptance by the Client is expressed by ticking the relevant box, with that intent, on the booking form.

3.3. The Contract will be automatically cancelled if payment has not been made online or by bank transfer within 30 days.

3.4. When booking any accommodation, the Client must correctly fill in the respective booking form, available on the Website, indicating, in particular, the dates of arrival and departure, always subject to confirmation of availability by Quinta da Côrte, the type of room/accommodation desired, payment methods, as well as their personal data and payment information, taking full responsibility for the choices made and the information provided, which must be complete, true and up-to-date.

3.5. The Client should carefully read the descriptions and information provided regarding the type of rooms/accommodation, which allow to know their essential characteristics, services included and associated rates, before finalizing the accommodation booking process. The rooms/accommodation offered by Quinta da Côrte include three types – standard, superior, and twin – best described on the Website.

3.6. Any special requirements or needs must be communicated on the booking form, however, there is no guarantee that they will be satisfied, and they are always subject to availability and confirmation by Quinta da Côrte.

3.7. After completing the booking form, a summary of the booking will be displayed, indicating the dates, number of nights, room type and total price, which the Client must check before confirming the booking.

3.8. In cases where the Client has a promotional code, it must be inserted in the field “Promotional Code” and submitted, in the booking form, prior to its confirmation.

3.9. After completing and finalizing the booking, the Client will receive an email acknowledging receipt of the booking, as well as the details of the accommodation booked, the price and the date of the booking.

3.10. Data registered by Quinta da Côrte constitutes proof of all the transactions carried out between Quinta da Côrte and the Client. Quinta da Côrte archives the electronic document which formalizes the Contract and keeps it accessible.

3.11. The Client is solely responsible for possessing and/or obtaining the necessary documents (such as identification documents, authorisations, visas, vaccination certificates, etc.) required to enter the country, the locality where the accommodation is located and/or to stay at Quinta da Côrte accommodation and must obtain prior and timely information in this regard when booking the accommodation.

3.12. Quinta da Côrte, may, at any time, change the value of existing rates, except for bookings or pre-bookings already made.

4. PRICE AND PAYMENT OF THE BOOKING

4.1. The price of the rooms/accommodation can be checked on the Online Room Bookings page and the respective booking form. The total price is presented in euros and includes the VAT at the legally applicable rate.

4.2. The payment is made at the time of the online booking or within 30 (thirty) days prior to the arrival date, depending in the Client’s choice.

4.3. The Client will have access, on the Website, to the following payment methods:

4.3.1. ATM;

4.3.2. MBWAY;

4.3.3. Visa, Visa Electron, Mastercard, Mastro

4.3.4. Bank Transfer.

4.4. Bookings, changes to bookings, and cancellations may be subject to charges by Quinta da Côrte, calculated based on the type of booking, dates of the stay or the respective change or cancellation.

5. BOOKING CANCELLATION POLICY

5.1. The Client acknowledges and accepts that, since this is a provision of accommodation for non-residential purposes, the Client cannot freely withdraw from the Contract, in accordance with the provisions of paragraph k), of number 1, of article 17 of Decree-Law no. 24/2014, 14 February, in its current wording. Without prejudice, Quinta da Côrte offers the following cancellation policy:

5.1.1. The Client may cancel, without any penalty, up to 30 days prior to the arrival, with full refund of the payment made.

5.1.2. If the Client wants to cancel the booking with less than 30 days before the arrival date, there will be no right to a refund of the amount charged.

5.2. In cases provided for in 5.1.1, the refund will be carried out within 30 days of the date of cancellation of the booking.

6. USER RESPONSIBILITY

6.1. Quinta da Côrte reserves the right to change these Terms and Conditions at any time, by simply publishing the changes online on the Website, indicating the date of the update, and it is the User’s sole responsibility to check and comply with them at the time of each use. The use of the Website after the changes have been published constitutes acceptance of the updated wording of the Terms and Conditions. If you do not agree with the changes made or, in general, with the Terms and Conditions, you must immediately stop using the Website and the Services.

6.2. By accessing, using and downloading materials from the Website, the User agrees, on his/her own behalf and/or on behalf of the entity on whose behalf he/she is acting, to comply punctually with the provisions of these Terms and Conditions, guaranteeing that he/she has the power to act on behalf of the third party he/she represents, should this prove necessary.

6.3. The use of the Website for purposes other than those for which the Website is intended is expressly prohibited, including illegal purposes or any other that may be considered harmful to the image of Quinta da Côrte. Usurpation, counterfeiting, utilisation of usurped or counterfeited content, illegitimate identification and unfair competition shall give rise to criminal and/or administrative liability.

6.4. Access (or attempted access) to the Website and/or the Services by automated means (including the use of scripts or web crawlers) is expressly prohibited.

6.5. The User is also prohibited from creating or introducing into this Website any type of virus or programme that damages or contaminates it, or from advising third parties to do so.

7. INDUSTRIAL AND INTELLECTUAL PROPERTY RIGHTS

7.1. All the information contained on the Website and all the data and information compiled by Quinta da Côrte associated with it, namely the Contents, to which the User has access as part of the Services or through the use of the Website, are considered Quinta da Côrte contents. The User is not permitted to modify, rent, lend, borrow, sell, distribute, or create a derivative work based on the aforementioned content (in part or in full), unless they have been expressly authorised in writing to do so by Quinta da Côrte or by a third party that owns the respective intellectual property and personality rights.

7.2. The User recognises and agrees that Quinta da Côrte holds all intellectual property rights (whether such rights are registered or not and in any part of the world where such rights may exist) relating to the contents of the Website and Services. Quinta da Côrte holds all rights not expressly granted to the User in these Terms and Conditions.

7.3. The User further agrees not to remove, conceal or alter any intellectual property rights notices (including copyright and trademark notices) that may be affixed to or inserted in the contents of the Website.

7.4. Trademarks and Similar

Unless expressly authorised by Quinta da Côrte to do so, nothing in these Terms and Conditions gives the User the right to use any of Quinta da Côrte’s trademarks, commercial brands, logos, domain names and other distinctive brand features.

8. LIMITATION OF LIABILITY

8.1. Quinta da Côrte will exercise reasonable diligence to ensure that all information contained on the Website is accurate and up to date.

8.2. However, the use and reading of the contents of this Website are carried out exclusively at the User’s own risk and are made available “as is” and “as available”. By accessing the Website, the User recognises and accepts that its content may be incomplete, inaccurate, not up to date, or may not meet their needs and requirements.

8.3. The Users are solely and exclusively responsible for their use of the Website and its content and for evaluating the information obtained through the Website.

8.4. Quinta da Côrte takes appropriate security measures to detect the presence of viruses. However, Users should be aware that security measures for computer systems on the Internet are not entirely reliable, and therefore Quinta da Côrte cannot guarantee the absence of viruses or other elements that may cause changes to the User’s computer systems (software and hardware) or the electronic documents and files contained therein.

8.5. Quinta da Côrte assumes no responsibility for damages resulting from the inability to access services provided through the Website or damages caused by viruses, service interruptions, content cancellation, Internet-related issues, or related to the non-existence and/or faulty functioning of the User’s electronic devices.

8.6. If you disagree, in whole or in part, with the Website or these Terms and Conditions, you have the sole right to stop using the Website.

9. LINKS TO OTHER WEBSITES

9.1. To facilitate the User’s accessibility, Quinta da Côrte may provide links to other websites of interest that are owned or operated by third parties.

9.2. When accessing other third-party websites, the User must consult and accept the rules of that website before using it. Quinta da Côrte does not control the content of that website and assumes no responsibility for the materials created or published by these third-party websites. Furthermore, any hyperlinks to a website that is not Quinta da Côrte’s are included for information purposes only and for the convenience of the User, and do not imply that Quinta da Côrte endorses the website, or the products and services referenced therein.

10.1. The Privacy Policy is available at [INSERT LINK]. The document contains an explanation of the procedures adopted by Quinta da Côrte with regard to the processing of its Users’ personal data and the protection of their privacy when using the Website.

12. MISCELLANEOUS PROVISIONS

12.1. In the event that one or more provisions of these Terms and Conditions are deemed invalid or declared as such by application of the law or a final decision issued by a competent court, the remaining provisions shall remain valid and effective.

12.2. These Terms and Conditions, as well as User’s relationship with Quinta da Côrte in accordance with them, are governed by the applicable Portuguese law.

12.3. The User and Quinta da Côrte agree to submit to the exclusive jurisdiction of the Judicial Courts of the District of Porto the resolution of any dispute relating to the interpretation and/or execution of these Terms and Conditions, without prejudice to the applicable mandatory legal rules.

12.4. The User, who is a consumer, may freely obtain information on the possibility of resorting to the Alternative Dispute Resolution Entities (“RAL”, available at www.consumidor.pt).

12.5. Quinta da Côrte informs the User who is a consumer that consumer disputes of low economic value (up to € 5,000) are subject to necessary arbitration or mediation when, at the express option of the consumers, they are submitted to the arbitration court attached to the legally authorised consumer dispute arbitration centres in national territory. The User may consult, at any time, the list of Alternative Dispute Resolution Entities available under article 17 of Law no. 144/2015, of 8 September, in its updated version, available in the Consumer Portal at: www.consumidor.gov.pt

12.6. Users who are consumers can also use the European Commission’s online alternative dispute resolution platform, accessible via the following link: https://ec.europa.eu/consumers/odr.

12.7. Notwithstanding the above information, Quinta da Côrte may apply precautionary measures (or equivalent types of urgent legal compensation) in any jurisdiction.
